These terms govern the use of the fateel.sa website and the request of services from Fateel Tech for Information Technology, including technical consulting, requirements analysis, design, the development of websites, applications, and digital platforms, support and maintenance, and any other services agreed upon with the client inside or outside the Kingdom of Saudi Arabia.

1. Definitions and Acceptance of Terms

"Fateel", "we", or "the Company" refers to Fateel Tech for Information Technology. "Client" or "User" refers to any person or entity that uses the site or requests a service from Fateel. By accessing the site, submitting a service request, or accepting a quotation, you agree to be bound by these terms. If you represent an entity, you confirm that you have the legal authority to bind it to these terms.

  • Commercial registration: 5850137724.
  • Tax registration number: 311765862800003.
  • Registered business address: Abha, Al-Muruj District, Abu Hurairah Road.

3. Scope of Services

Fateel provides technical services that include, as agreed, ideation studies, requirements analysis, user experience and interface design, website and application development, building digital platforms and products, integration with external systems, hosting or technical configuration, support, maintenance, and subsequent enhancements. No general information on the site constitutes a binding offer unless stated in an approved quotation, contract, or statement of work.

4. Client Accounts and Request Authority

Some services may require creating accounts, granting Fateel access permissions, or appointing an authorized representative to communicate and make decisions. The client is responsible for the accuracy of the data provided, for protecting their accounts, passwords, and access keys, and for notifying Fateel immediately upon suspecting any unauthorized use.

5. Quotations, Contracts, and Statement of Work

The scope of work, deliverables, timelines, approval mechanism, fees, payments, and any special terms are defined in the quotation, contract, or statement of work. In case of conflict, priority is given to the document signed or approved between the parties, then to these terms to the extent they do not conflict with it.

6. Managing Subscriptions and Ongoing Services

If a service includes a recurring subscription, hosting, maintenance, licenses, or ongoing support, the subscription period and the renewal, cancellation, and fee mechanism are set out in the quotation or contract. Failure to pay on time may lead to suspension of the service or halting of renewal after notifying the client by an appropriate means.

7. Fees, Payment, and VAT

Fees are in Saudi Riyals unless the parties agree otherwise. Value-added tax or any applicable statutory fees are added to invoices in accordance with Saudi regulations, and tax treatment is issued under the name Fateel Tech for Information Technology and tax registration number 311765862800003. The client undertakes to settle payments on the agreed dates without unjustified deduction or delay.

8. Activation, Cancellation, and Refunds

Service execution begins after acceptance of the quotation or signing of the agreement and receipt of the payment or agreed requirement. The client is not entitled to a refund after execution has begun, the service has been activated, or external licenses and tools have been purchased in their name, unless the agreement expressly states otherwise or a material defect for which Fateel is responsible is established and could not be remedied within a reasonable period.

9. Technical Support and Service Levels

Fateel provides support according to the channels, durations, and response scope set out in the contract or quotation. Support services do not cover faults resulting from unauthorized modification, use contrary to instructions, interruption of third-party services, or issues in infrastructure not managed by Fateel, unless otherwise agreed.

10. Modifications and Additional Requests

Any request that exceeds the approved scope of work — such as adding new features, a material change to the design, additional integrations, data migration, domain customization, or changing a technical structure after approval — may require an additional quotation or an adjustment to cost and duration. The client's written or electronic approval is considered consent to this.

11. Client Obligations

The client undertakes to:

  • Provide Fateel with information, content, approvals, and permissions in a timely manner.
  • Ensure that the materials provided do not infringe the rights of others or applicable regulations.
  • Review deliverables within the agreed approval periods and provide clear, consolidated feedback.
  • Use the services lawfully and not request the execution of unlawful, misleading, or harmful work.
  • Keep backups of their data whenever the service or contract does not provide for Fateel to do so.

12. Prohibited Use

Using the site or Fateel's services in any of the following is prohibited:

  • Attempting to hack, exceed permissions, or disable the site, systems, or servers.
  • Sending malware or fraudulent content, or content that violates regulations or intellectual property rights.
  • Collecting others' data without a legal basis, or using the services for spam or misleading activities.
  • Reselling the service or representing it to others in a way that breaches the agreement or harms Fateel's reputation.

13. Intellectual Property

Fateel retains ownership of its tools, methodologies, general code, templates, expertise, and pre-existing technical know-how. After full payment of dues, the client obtains the right to use the agreed final deliverables within the scope of the contract. Open-source software and third-party services remain subject to their own licenses and terms.

14. Confidentiality and Data Protection

Both parties undertake to maintain the confidentiality of non-public information each obtains while studying or executing the service. Fateel processes personal data in accordance with the privacy policy published on the site and in compliance with the applicable regulatory requirements in the Kingdom of Saudi Arabia.

15. Third-Party Services

Services may involve the use of hosting, domain, payment gateway, messaging, mapping, analytics, or external software library providers. These services are subject to their providers' terms, and Fateel does not guarantee their continuity, prices, or policies, but exercises professional care in selecting and integrating them within the agreed scope of work.

16. Suspension and Termination

Fateel may suspend the service or terminate the engagement upon a breach of these terms or the contract, delay in payment, the existence of security or regulatory risks, or use of the service in a way that harms Fateel or others. Suspension or termination does not affect amounts due for work already performed or obligations arising before the termination date.

17. Limitation of Liability

To the extent permitted by law, Fateel is not liable for indirect or incidental damages or loss of profits or data arising from use of the site or services, especially where the damage results from inaccurate information provided by the client, third-party intervention, or circumstances beyond reasonable control. This clause does not limit any liability that may not be excluded by law.

18. Force Majeure

No party is considered liable for delay or failure resulting from circumstances beyond reasonable control, such as disasters, official decisions, general outages, large-scale attacks, or the failure of essential infrastructure providers' services, provided the other party is notified and what is necessary is done to mitigate the impact where possible.

19. Governing Law and Jurisdiction

These terms are governed by and interpreted in accordance with the regulations of the Kingdom of Saudi Arabia. The parties seek to resolve any dispute amicably first; failing that, jurisdiction lies with the competent judicial authorities in the Kingdom of Saudi Arabia, unless the parties agree in writing on another settlement method that does not conflict with the law.

20. Updating the Terms

Fateel may update these terms from time to time due to changes in services or regulatory or operational requirements. An update takes effect upon publication on this page, and continued use of the site or request of services after publication is considered acceptance of the updated version.
